Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Khodawandpur P.S. Case No. 81 of 2022 lodged under Sections 395, 397, 307, 326 of the I.P.C. read with Section 27 of Arms Act.

As per the prosecution case, informant has disclosed before the police that he was working in a jewellery shop. On the date of occurrence, he alongwith his brother returning from the shop closing it then 7 criminals on 3 motorcycles chased and stopped them and fired on the brother of the informant and looted Rs. 2.5 lacs, jewellery of gold about 100 gm, silver about

Subsequently, the informant has called the relatives who reached there and the brother was admitted to the local hospital at Begusarai who was subsequently referred to Patna.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits that the criminal case has been filed against 7 unknown persons. He further submits that in the case diary, the name of the present petitioner has come by virtue of confessional statement of coaccused, namely, Kundan Kumar who has been apprehended by the police and on his confession the alleged looted ornaments has been recovered which was sold in the shop of the petitioner Learned counsel for the petitioner submits that he is innocent and in custody in this case since 19.04.2022 and his antecedent is clean.

Learned counsel for the State opposes the prayer for bail.

Learned counsel for the informant vehemently opposes the prayer for bail and submits that there is complete involvement of the present petitioner in this case. He submits that the Additional Sessions Judge Begusarai has categorically

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but petitioner may renew his prayer for bail only after 5 months of framing of charge and Trial Court is directed to release the petitioner on bail imposing its own conditions so that he may not evade his appearance during trial. With this observation, the bail application stands rejected.
