Patna High Court CWJC No.13268 of 2019(2) dt.02-12-2022 2/2 alleged to have misappropriated by the accused named in FIR bearing Motihari Town P.S. case no. 195/2010, proceeding initiated on the basis of said FIR which is pending.

(ii) For an issuance of writ commanding the respondents to re-call the notices and case of certificate against the petitioner and also to drop the certificate case no. 03/Gawan/16-17 in the view of the Criminal case as well as proceeding is pending as yet. (iii) For issuance of appropriate writ, order/orders or direction/s which your lordship may deem fit and proper in the facts and circumstances of the case."

Learned counsel for the petitioner, under instructions, states that, in view of the intervening developments, the petition may be permitted to be withdrawn. Prayer allowed.

Petition is disposed of as withdrawn.
