Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 399, 402 and 414 of the Indian Penal Code, Sections 25 (1-b)a, 26 and 35 of the Arms Act and Sections 20 and 22 of the NDPS Act, registered in connection with Ghorasahan P.S.Case No. 477 of 2020.

On a secret information that some miscreants were planning to commit loot in a shop, the police reached the place of occurrence. After seeing the police, four miscreants became

Patna High Court CR. MISC. No.48085 of 2021(2) dt.18-05-2022 2/3 successful in fleeing away, whereas three miscreants seated on a glamour motor-cycle were apprehended. They disclosed the name of the petitioner amongst the persons, who fled away from the place of occurrence.

The learned counsel for the petitioner has submitted that he is innocent and he has not committed any offence and has falsely been implicated in this case. His name has figured in the confessional statement of the co-accused and except the confessional statement, there is nothing against the petitioner. He has also submitted that the petitioner is a person of clean antecedents.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. East Champaran, Motihari in connection with Ghorasahan P.S.Case No. 477 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided
