JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 1903 of 2012 in which cognizance has been taken for the offence punishable under Section 498 A of the Indian Penal Code.

Petitioner happens to be husband of the opposite party no. 2 (complainant) and it appears from perusal of the complaint petition that earlier complainant had filed criminal case as well as maintenance case against the petitioner and furthermore, I find that petitioner is making payment of maintenance to the complainant. The marriage of the petitioner had taken place with the complainant in the year 1990 and the present complaint case

Patna High Court Cr.Misc. No.9714 of 2015 (2) dt.12-03-2015 was filed in the year 2012.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Gopalganj in Complaint Case No. 1903 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
