JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A and 304B/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after six years of the marriage for non-fulfillment of the dowry demand.
It is submitted by learned counsel for the petitioner that the informant himself stated that there was no demand of dowry, hence the case does not come within the purview of Section 304B of the IPC. Moreover, on conclusion of investigation, final form (chargesheet) was submitted under Section 306 IPC.
Patna High Court Cr.Misc. No.17451 of 2016 (3) dt.20-05-2016 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Rajoun P.S. Case No. 217 of 2015 pending in the court of learned CJM, Banka.
Accordingly, the application is disposed of.
