JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 This is an application for grant of anticipatory bail in connection with Makhdumpur P. S. Case No. 80 of 2019, disclosing offences under Sections 341, 342, 323, 379, 504, 506, 34 of IPC.
Allegation against the petitioner is of snatching the mobile phone worth Rs. 1800/- and there is also allegation against him of assaulting the informant, causing injury to him. It further appears that petitioner is accused in one more case. Submission of learned counsel for the petitioner is that in earlier cases informant is working as advocate and he has lodged the present case in order to support the case of the informant in that case.
Heard learned APP as well as learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that there is one more complaint against the
Patna High Court CR. MISC. No.38306 of 2019(3) dt.02-09-2019 2/2 petitioner, in which process has already been issued against the petitioner in the year 2017 itself.
Having heard both sides, considering the facts as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, if he may surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit, without being prejudiced by order of this Court and if, possible to be disposed of on the same day.
