The petitioner apprehends his arrest in Biraul P.S. Case No. 178/2015 registered under Sections 363, 366, 366(A), 420, 120(B) of the Indian Penal Code.
The father of the victim made allegation that the petitioner took his daughter for domestic help to his friend Gauri Shankar Jha but when after some time he went to the house of Gauri Shankar Jha, he did not find his daughter there. It is submitted that the victim was released in favour of one Sushma Verma and said Sushma Verma lodged Sanaha before Agamkuan Police Station on 22.04.2013 to the effect that Rekha Kumari, aged 13 years, was missing from her house. Rekha Kumari was handed over to Prayas Bharati Trust, Patna by a common man on 30.04.2013. It is further submitted that the victim was released in
Patna High Court Cr.Misc. No.16895 of 2016 (3) dt.14-07-2016 2/2 favour of the informant on 22.12.2015 but it appears from the order of the learned Sessions Judge that the victim made her statement under Section 164 of the Code of Criminal Procedure wherein she very categorically stated that the petitioner took her and sold her to an unknown person for domestic help and from there she fled away.
Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail in Biraul P.S. Case No. 178 of 2015. Accordingly, the same is rejected.
