The petitioners apprehend their arrest in a case under Section 353/34 of the Indian Penal Code and under section 139/140 of the Electricity Act.
The informant is Junior Engineer of Electricity department who found breakdown of 33 KV line disrupting the supply of electrical energy and named the petitioners on mere suspicion that petitioners were working as labourer and they were
Patna High Court Cr.Misc. No.15389 of 2016 (2) dt.26-04-2016 2/2 to go on strike since 11.02.2016.
It appears that nobody has seen the petitioners disrupting the energy supply and only on suspicion the petitioners are named in the FIR.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Electricity), Magadh Area, Gaya in Amas P.S. Case No. 32 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
