JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 22-06-2016 The petitioner had approached this Court earlier for grant of pre-arrest bail vide Cr. Misc. No. 50535 of 2015 and the application preferred under Section 438 of the CrPC for grant of pre-arrest bail was rejected vide order dated 05.11.2015. He has renewed his prayer for grant of pre-arrest bail on the ground of compromise entered into between the informant and the petitioner.

In my view, such an application is not compoundable in nature. Apparently, the petitioner is trying to obtain bail by tampering with the evidence at the stage of investigation.
