JUSTICE RAVI RANJAN ORAL ORDER 23-05-2016 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offences punishable under sections 323, 341, 353, 504 and 506 of the Indian Penal Code.

As per the allegation, the informant(DCLR-cum-District Incharge Officer, Mid-day Meal Scheme, Supaul) received threat from mobile no. 8539802132 that if he takes action against the Headmaster then he will have to face dire consequence and he was informed on phone that the caller was Mukhiya of the village. On inquiry it was found that the Mukhiya of the village is Smt. Ful Kumari Devi whereas the caller was her husband, i.e. the petitioner.

Learned counsel for the petitioner submits that it is not

Patna High Court Cr.Misc. No.16027 of 2016 (2) dt.23-05-2016 stated in the First Information Report as to how the informant came to the conclusion that the caller was the husband of the Mukhiya. It is urged that, even as per the allegation, only threat was given by somebody. The petitioner claims to have clean antecedent.

Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Arjun Mehta @ Arjun Prasad Mehta, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Supaul Police Station Case No. 216/2013 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul subject to the conditions laid down under subsection (2) of Section 438 of the Code of Criminal Procedure.
