Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 413, 414, 420/34 of the Indian Penal Code and 47(A) of the Excise Act.
Prosecution case is that the liquor shop of the petitioner was raided, when it was found that petitioner's having license for country made liquor, used to keep the foreign liquor also. Consequently huge quantity of liquor was recovered.
It is submitted by the learned counsel for the petitioner that petitioner was not present at the time of raid and the liquor license has already been cancelled. The aforesaid facts shall be considered by the learned court below, if the petitioner surrenders before the
Patna High Court Cr.Misc. No.14380 of 2015 (2) dt.07-04-2015 learned court below within a period of six weeks from today and prays for regular bail in connection with Nirmali P.S. Case No. 152 of 2014, pending in the court of learned Judicial Magistrate, Ist Class, Birpur, Supaul.
With this observation this application is disposed of.
