2. The petitioner is apprehending his arrest in connection with Pusa P.S.Case No.60 of 2024, FIR dated 27.06.2024 registered for the offences punishable under Sections 326A,34 of IPC.

3. According to prosecution case, three accused persons namely, Manish Kumar, Akhilesh Paswan and petitioner came on a new pulsor Bike and threw acid on the sister-in-law of the informant but the acid fell on the informant and Rukesh Kumar causing burn on the face, chest and arms of informant and also on the left arm of Rukesh Kumar.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.36030 of 2025(2) dt.10-07-2025 2/2 petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. As per allegation in the FIR, the petitioner and other co-accused persons threw the acid on the sister-in-law of the informant but the acid fell on the informant and one Rukesh Kumar and the informant and Rukesh Kumar have received the injury.

5. Learned A.P.P. for the State, on other other hand, has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the nature of allegation in the FIR that the petitioner and other co-accused persons threw the acid, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Pusa P.S.Case No.60 of 2024 pending in the court of learned J.M.-1st Class, Samastipur.

7. Prayer is refused.
