JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

A supplementary affidavit has been filed today on behalf of the petitioner bringing on record a copy of the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure. From the said statement it appears that her age has been assessed to be 23 year as on 26.6.2015. She has stated that she had married Md. Nashirul out of her own free will. Keeping in view the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, let

No.13314 of 2015 (6) dt.30-07-2015 petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Basopatti P.S. Case No. 164 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
