JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 27-04-2016 The present application has been filed for modification of the order dated 17.03.2016 passed in Cr. Misc. No. 11704 of 2016, whereby the petitioner was granted anticipatory bail in connection with Bihra P.S. Case No. 211 of 2015, pending in the court of the learned Judicial Magistrate-1st Class, Saharsa with certain conditions.

The learned counsel appearing on behalf of the petitioner submits that the correct name of the father of the petitioner is late Kokai Yadav, but due to inadvertence the father name of the petitioner in the anticipatory bail application was mentioned as Jokai Yadav, as a result of which despite order of anticipatory bail passed by this Court, the petitioner could not be released on bail.

The learned Addl. P.P. appearing on behalf of the State does not raise any objection.

In the aforesaid facts and circumstances, the prayer for modification is allowed and the name of the father of the petitioner be read as "late Kokai Yadav" instead of "Jokai Yadav".

Patna High Court Cr.Misc. No.16518 of 2016 (2) dt.27-04-2016 2/2 The period of surrender of the petitioner is also extended for three weeks from today.

With the aforesaid modification in the order dated 17.03.2016 passed in Cr. Misc. No. 11704 of 2016, the present application stands finally disposed of.
