Having regard to the nature of allegation against the petitioner for the offence punishable under Sections302/34 of the Indian Penal Code and Section-3(i)(x) SC/ST Act, this Court is not inclined to grant anticipatory bail to the petitioner, inasmuch as, the petitioner also is said to be armed with a gun and was a member of the mob which had done to death of the deceased. Thus, the petitioner would not be entitled for grant of anticipatory bail.
That being so, the prayer for anticipatory bail of the petitioner is hereby rejected.
It is also made clear that nothing said in this order
Patna High Court Cr.Misc. No.35447 of 2014 (2) dt.11-02-2015 however would come in the way of the petitioner in surrendering before the Court below and praying for regular bail.
