The petitioner is languishing in custody since 20.11.2018 in a case registered for the offences punishable under Sections 25(1-B)a/25(1-AA)/26/35 of the Arms Act. It is alleged that from the possession of the petitioner four live cartridges were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent, statement to that effect has been made in paragraph 3 of the petition and the investigation has already been concluded. Learned APP submits that the recovery of four live cartridges were made from possession of the petitioner. Considering the nature of recovery and statement
