The petitioners, namely, Ravibhushan Tiwari, Master Sahani, Mintu Devi and Hari Baitha, apprehend their arrest in a case under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.
The informant alleged that a piece of land of Khata No. 20, Khesra No. 318 measuring 91⁄2 Dhurs fell in his share but Ashok Tiwary and Ravibhushan Tiwary sold the said land in favour of Mintu Devi by a forged sale deed wherein Master Sahani and Hira Baitha are the witnesses. It is submitted that Ram Lakhan Tiwari had three sons, namely, Yamuna Tiwary, Ashan Tiwary and Mathura Tiwary. Madan Mohan Tiwary (the informant) is the
Patna High Court Cr.Misc. No.17181 of 2016 (2) dt.16-05-2016 2/2 son of Yamuna Tiwary and Ashok Tiwary and Ravibhushan Tiwary are the sons of Mathura Tiwary. The informant is the cosharer of Ashosh Tiwary and Ravibhushan Tiwary, who sold the land of their shares. The informant has not filed any paper showing that the disputed land fell in his share which was sold by the petitioners by preparing a forged sale deed. Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Motihari P.S. Case No. 131 of 2015, corresponding to G.R. Case No. 828/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
