ANJANA MISHRA ORAL ORDER 30-06-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Baniyapur P.S. case no. 40/2016 for allegedly having committed the offence under Section 409 of Indian Penal Code.

Case diary in the present case was called for, which has since been received.

After hearing learned counsel for the petitioner and learned counsel for the State and considering the reply filed by the petitioner by way of supplementary affidavit, it appears that a substantial amount of fund has been invested towards the construction of Urdu Primary School.

Patna High Court Cr.Misc. No.17503 of 2016 (5) dt.30-06-2016 2/2 Learned counsel appearing on behalf of State submits that save and except the allegation, there is no other material in the case diary to implicate the petitioner. Taking into consideration aforesaid facts and circumstances, let the petitioner abovenamed, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Saran at Chapra in connection with Baniyapur P.S. case no. 40 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
