JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 26-10-2021 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Rahui (Wena) P.S. Case no. 32 of 2020- G.R. No. 718 of 2020 instituted for the offence under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.

As per allegation in the FIR, petitioner has given his land to the informant on patta. On the alleged date of occurrence petitioner called the informant to pay the patta amount. It is alleged that when the informant went to pay his patta amount, he was brutally beaten up by their muscles men including the petitioner.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.34468 of 2020(4) dt.26-10-2021 2/2 has submitted that petitioner is innocent and has been falsely been implicated in this case. Main allegation of overt act and assault is against Sujeet Kumar and not against this petitioner. He is of clean antecedent. Against the petitioner, there is omnibus allegation.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Rahui P.S. Case no. 32 of 2020, G.R. No. 718 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nalanda at Biharsharif subject to the conditions as laid down under section 438(2) of the Cr.P.C.
