1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Dawath Police Station Case No. 30 of 2025, disclosing offences under Sections 110, 318(3), 318(4), 319(2), 3(5) of the BNS, 2023 and Sections 40, 41(1) (2) of the Clinical Establishments (Registration and Regulation) Act, 2010.

3. As per the prosecution case, on 22.01.2025, the informant along with others including Chief Medical Officer inspected the nursing home and found that some patients were being treated/operated there without doctor and compounder. The patients were brought back to the Community Health Center at Rohtas. The nursing home was being operated from

4. Learned counsel for the petitioner submits that petitioner has been made accused merely because the clinic was being run in his market. The room in the market was given to one Dr. Bikash Chandra Jain on monthly rent and the petitioner was not aware that clinic was being run without any permission under the Clinical Establishments (Registration and Regulation) Act, 2010. It is not the case of the prosecution that the petitioner was running the clinic himself.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that petitioner let out a room in his market, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bikramganj, Rohtas, in connection with Dawath Police Station Case No. 30 of 2025, subject to the condition laid
