2. The petitioners apprehend their arrest in connection with Bodh Gaya P.S. Case No. 49 of 2024 registered for the offences punishable under Sections 406, 420, 467, 468/34 of the IPC.

3. Petitioner no. 1 is mother of the informant whereas petitioner no. 2 is the elder brother of the informant. As per allegation, they have sold the land of the informant and the purchaser thereof was attempting to evict the informant.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. They are the persons of clean antecedents. It has further

Patna High Court CR. MISC. No.36357 of 2025(4) dt.25-11-2025 2/2 been submitted that to meet out some family needs, petitioner no. 1 who is mother of the informant sold the land in the year 2005. The land which was sold, was not allotted to the informant.

5. On the other hand, learned counsel for the informant opposed the prayer for anticipatory bail of the petitioners.

6. Vide order dated 18.06.2025, the matter was referred to the Patna High Court Mediation and Conciliation Centre for exploring the possibility of amicable settlement of the dispute between the parties. The petitioners were present on three consecutive dates but none appeared on behalf of the informant (O.P. No. 2).

7. It appears to be a matter of civil nature.

8. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Bodh Gaya P.S. Case No. 49 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) priyanka/- U T
