The petitioner apprehends his arrest in a case under Section 7 of the E. C. Act.

One pick-up van bearing registration No. BR-1W/ 7745 was intercepted while carrying 33.50 quintal of wheat of State Food Corporation. The driver of the vehicle was apprehended. The petitioner is the owner of the vehicle. It is submitted that petitioner has already transferred the vehicle in the name of driver but the owner book was not transferred. It is further submitted that the petitioner had no manner of concern with the consignment carrying by the driver in the vehicle.

Considering the facts aforesaid and the fact that

Patna High Court Cr.Misc. No.15343 of 2016 (2) dt.25-04-2016 2/2 petitioner is owner of the vehicle and the driver of the vehicle was carrying the wheat, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjeeb Kumar, learned Judicial Magistrate, 1st class, Siwan in Daraudha P.S. Case No. 217 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
