2. Petitioner seeks regular bail in connection with Ghosi (Okari) P.S. Case No. 510 of 2021 dated 27.11.2021 registered for the offences punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.
3. The main submissions advanced by learned counsel for the petitioner are that the allegations levelled against the petitioner are totally false and the victim has been recovered and in the FIR, mere suspicion was raised against the petitioner and in the present time, both the parties have compromised the present matter and the petitioner is a poor farmer and labourer and one similarly situated co-accused person namely Shibu Prasad has been granted bail by a co-ordinate Bench of this
Patna High Court CR. MISC. No.44271 of 2023(2) dt.24-07-2023 2/2 Court vide order passed in Cr. Misc. No. 50496/2022. Further submissions are that the petitioner has fair and clean antecedent and has been languishing in jail since 18.11.2022 and against him, the investigation has been completed.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Having regard to the facts and circumstances of this case and considering the above submissions and mainly the petitioner's fair and clean antecedent and also the privilege of bail having been granted to above-named co-accused person, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Ghosi (Okari) P.S.
