The petitioner seeks bail in Manigachhi P.S. Case No. 100 of 2018, instituted for the offence under Section(s) 341, 323, 324, 307, 337, 379, 427 and 504/34 of Indian Penal Code. Counsel for the petitioner submits that allegation against the petitioner of assaulting the informant with iron rod on his head causing injury to him is totally false because there is no injury report of the informant available on record. It is alleged in the written report that petitioner assaulted the informant with iron rod on his head and Suraj Lal Dev with Khanti on his mouth causing injury to them. The injury report of Suraj Lal Dev has been enclosed as Annexure-3

Patna High Court CR. MISC. No.37685 of 2019(2) dt.21-06-2019 2/2 wherein the Doctor has found lacerated wound measuring 2" x 1" x 1⁄4" on his left cheek which was found to be simple in nature caused by hard and blunt substance.

It is mentioned in paragraph-14 of the bail petition that no injury report of the informant Raushan Kumar Lal Dev is available on the record.

Petitioner is in custody since 14.2.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Darbhanga, in connection with Manigachhi P.S. Case No. 100 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
