2. The petitioners seek bail in a case registered for the offences punishable under Section 393 of the Indian Penal Code.

3. The prosecution case, as disclosed in the F.I.R., is that the informant was intercepted by some unknown miscreants, who tried to snatch away his mobile and money but, upon alarm being raised by him, the accused persons fled away.

4. It is submitted by learned counsel for the petitioners that it would be apparent from the first information report that the same has been lodged against unknown

No.36602 of 2025(3) dt.22-08-2025 2/3 miscreants and the name of the petitioners has transpired on the confessional statement of co-accused, Pradeep Kumar, during the course of investigation, and the said Pradeep Kumar has already been granted bail by this Court vide order dated 29.05.2025 passed in Cr. Misc. No.22512 of 2025. It is further submitted that there is no recovery from the conscious or physical possession of the petitioners. The charge-sheet has been submitted against the petitioners and petitioners are languishing in custody since 01.02.2025.

5. Learned APP for the State opposed the bail petition on the ground that petitioner no.1 has six criminal antecedents, while petitioner no.2 has four criminal antecedents. However, it is submitted on behalf of the petitioners that the petitioners are on bail in all the cases. 6.

Taking into consideration the facts and circumstances of the case as well as the fact that co-accused has already been granted bail, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kasar P.S. Case No.04 of 2024.

7. However, the petitioners are directed to mark their attendance before the Sheikhpura Police Station once in a month till the disposal of the case. Further, it is directed that the petitioner would appear on each and every date fixed by the Trial Court in the case till the charges are framed and in case of default on two consecutive dates, the learned Trial Court would be at liberty to cancel the bail bonds of the petitioners.
