The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 342, 323, 307, 426 and 379 of the Indian Penal Code.
It is specifically alleged that co-accused Bijay Paswan assaulted the informant with knife whereas six accused persons including the petitioner snatched Rs. 15000/- from the pocket of the informant.
It is submitted by learned counsel for the petitioner that the petitioner is agnate of the informant and in the background of serious land dispute accusation has been levelled. There is no accusation of assault against the petitioner. A
Patna High Court Cr.Misc. No.9201 of 2015 (2) dt.10-03-2015 2 / 2 statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Salaiya P.S. Case No. 34 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
