JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Baheri P.S. Case no. 112 of 2015 registered under Sections 448, 341, 323, 504, 354 and 307/34 of the Indian Penal Code. The prosecution case is that petitioner along with Satish Kumar Singh and two unknown reached at the door of the informant Moni Kumari and boarded her on Bolero vehicle. The informant asked to leave her. Thereafter, all the accused persons started to case injury through pistol, axe and stick. At that time, petitioner no.4 Sanni Kumar Singh @ Sunny Singh caused injury to the butt of the pistol at the head of the informant, while the informant was being taking in the Bolero,
Patna High Court Cr.Misc. No.17003 of 2016 (3) dt.04-05-2016 2/2 on raising alarm, the other persons came then all are fled away from there.
Learned counsel appearing on behalf of the petitioner submits that due to land dispute occurrence took place in which defence side also sustained injury regarding which Baheri P.S. Case No. 118 of 2015 was instituted on the basis of written report of accused Satish Kumar Singh. Moreover, injuries as found on the person of the informant are simple in nature. Further submission is that co-accused Satish Kumar Singh has been granted privilege of bail by this Court on 28.01.2016 passed in Criminal Miscellaneous No. 47248 of 2015.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with Baheri P.S. Case No. 112 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
