JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-12-2025 At the outset, the learned counsel for the opposite party-State submits that in compliance of the order of this Court dated 16.10.2023, passed in CWJC No.5433 of 2023, the Circle Officer, Hajipur Sadar, Vaishali has passed the final order dated 22.07.2023 in Encroachment Case No.06/23-24 whereby and whereunder encroachment proceedings have been dropped.

2. In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the aforesaid order dated 22.07.2023 by filing appropriate encroachment appeal before the Collector, Vaishali. Liberty so

Patna High Court MJC No.1829 of 2024(5) dt.05-12-2025 2/2 sought is granted.

3. It is needless to say that in case appropriate encroachment appeal is filed within a period of four weeks from today, the same shall be examined on merit without the appellate authority being impeded by the issue of limitation.

4. Accordingly, the present petition stands disposed off on the aforesaid terms.
