The petitioner seeks bail in anticipation of his arrest in connection with Kudhani P.S. Case No. 668 of 2019, dated 13.10.2019, instituted for the offences under Sections 414, 467, 468, 471 and 34 of the Indian Penal Code and Sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.35085 of 2020(2) dt.19-03-2021 2/3 from the three vehicles and the arrested accused persons have named the petitioner and others. This is the basis for prosecuting the petitioner in the instant case. It has been submitted on behalf of the petitioner that none of the vehicles which have been seized and from where recovery has been made belongs to him. It has further been submitted that nothing has been recovered from the conscious possession of the petitioner and he enjoys a good reputation. No criminal case has been lodged against him in the past.

One of the accused persons of this case with similar allegation has been granted anticipatory bail by a Bench of this Court, which order has been annexed with the bail application.

Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to
