The petitioner seeks bail in Habibpur P.S. case No. 184/2019 registered u/s 394/411 of the IPC.

The informant alleged that when he reached at Dhobighat two miscreant caught the informant and his friend, stopped them and snatched his mobile. On alarm one miscreant was caught by the local people and the apprehended accused disclosed the name of another accused as Md. Sajan. The learned counsel for the petitioner submits that petitioner was apprehended on the spot and looted mobile was recovered from his possession but the petitioner is in custody since 10.11.2019 and he has already remained in jail for one year and two months but it appears that petitioner has got

Patna High Court CR. MISC. No.34374 of 2020(2) dt.15-01-2021 2/2 criminal antecedent and he is accused in another case of similar nature.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected.

The trial court is directed to hold the trial on day to day basis and conclude the same within three months from the receipt of this order.

The Superintendent of Police, Bhagalpur is directed to ensure the attendance of prosecution witnesses in the court of ACJM- XII, Bhagalpur so that the trial must be concluded within three months.

Let a copy of this order be sent to the court of ACJMXII, Bhagalpur and Superintendent of Police, Bhagalpur for information and needful.

If the trial is not concluded within three months, the petitioner, if so advised, may renew his prayer for bail. (Prabhat Kumar Jha, J) BKS/- U T
