1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 319(2), 318(4), 336(3) and 340(2) of the B.N.S.S.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and the informant alleges that one Chhote Lal Chaupal on 16.05.2024 applied for death certificate of his cousin namely Prithvi Lal Chaupal at the RTPS Centre, Madhepur, which was duly processed but before the death certificate could be issued, it was found that Prithivi Lal Chaupal is alive, it is next alleged that Chhotelal Chaupal had applied for death certificate of his cousin brother with an intent to misappropriate the loan amount of Rs.60,000/-. 4. Learned counsel for the petitioner submits that petitioner is Anganbadi Sevika of Ward No.9, while Prithvi Lal Chaupal whose death certificate was to be obtained is resident of Ward No.4. The learned counsel for the petitioner next asserts and submits that the petitioner was not even aware that such application has been filed seeking death certificate of Prithvi Lal Chaupal. It is also submitted that petitioner being Anganbadi Sevika of Ward No.9 could not have signed on the said document, when it was being processed for issuing death certificate. It is also submitted that the moment the petitioner came to know about the occurrence, she immediately submitted an application before the CDPO dated 07.10.

2024, as would manifest from Annexure-3 to the anticipatory bail application, wherein she has specifically stated that her signature on the application is forged. It is also submitted that being Anganbadi Sevika of Ward No.9, she could not have signed the said application with respect to a person who was resident of Ward No.4. It is next submitted that petitioner will not abscond rather will cooperate in the investigation to prove her innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Madhepur P.S. Case No.134/2024, subject to the conditions as laid down under Section 482(2) B.N.S.S.

However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner despite giving assurance to this court is not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
