Petitioner is aggrieved by the order dated 28.11.2014 passed by the District Magistrate, Begusarai in Arms Licence Case No.53/14 by which his application for grant of licence for N.P. Bore Rifle has been rejected. It is contended on behalf of the petitioner that the ground for refusal is lack of production of any evidence regarding threat perception which is in teeth of law laid down by a decision of this Court in C.W.J.C. No. 18535 of 2011 (Manish Kumar Vrs. State of Bihar) and other analogous cases.

Accordingly, this writ application stands allowed in

Patna High Court CWJC No.3814 of 2015 dt.14-09-2015 2 / 2 terms of the aforesaid C.W.J.C. No. 18535 of 2011 (Manish Kumar Vrs. State of Bihar) and other analogous cases. The impugned order is set aside and the matter is remitted back to the licensing authority to take a fresh decision in accordance with law within three months from the date of receipt/production of a copy of this order.
