JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the State. Petitioner is an accused in a case registered for the offence under sections 413 and 414 of the Indian Penal Code. Police party intercepted and seized a tractor with trailer and a motorcycle and arrested petitioner and three others who were going to sell the said stolen tractor. Learned counsel for the petitioner submits that the allegation against the petitioner is false and he is not concerned with the said stolen tractor which has already been released to its original owner by the Court below. Petitioner has got no criminal antecedent and is in custody since 31.1.2019. Similarly situated co-accused has already been allowed bail by this Court vide order dated 15.4.2019, passed in Cr.Mis.No. 24129 of 2019.

Considering the facts of the case, let the petitioner,

Patna High Court CR. MISC. No.36073 of 2019(3) dt.04-09-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl Chief Judicial Magistrate-VI, Saran at Chapra in Masrakh Police Station Case No. 41 of 2019, subject to the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
