Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Mokama P.S. Case No.50 of 2023 dated 08.02.2023, lodged under Sections 379, 399, 402 of the Indian Penal Code read with Sections 25(1-b)a, 26, 35 of the Arms Act.

As per prosecution case, the accused persons including the present petitioner are making plan for heinous crime and upon secret information the Police party raided and apprehended accused persons including the petitioner. From the possession of petitioner one loaded desi katta and eleven live cartridges were recovered.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.40410 of 2023(2) dt.12-07-2023 2/2 antecedent of petitioner is clean, he is in custody since 09.02.2023 and charge sheet has already been filed in this case. He further submits that co-accused person from whose possession one pistol and three live cartridges have been recovered has been granted bail by the Co-ordinate Bench of this Court vide order dated 21.06.2023 passed in Cr. Misc. No.31818 of 2023.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIII, Barh (Patna) in connection with Mokama P.S. Case No.50 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
