The petitioner seeks bail in connection with Excise P.S. Case No. 319 of 2020 instituted for the offences under Sections 30(a) and 56 (B) of the Bihar Prohibition and Excise Act, 2016.

It appears from the prosecution report that 253.500 litres of liquor has been recovered from a vehicle belonging to the petitioner.

Learned counsel for the petitioner has submitted that the recovery has wrongly been shown in the name of

Patna High Court CR. MISC. No.34521 of 2020(2) dt.21-12-2020 2/2 the petitioner.

He is in custody since 23.08.2020 and is a person of clean antecedent.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Excise P.S. Case No. 319 of 2020.
