2. Heard learned counsel for the petitioners and learned A.P.P. for the State.
3. The petitioners seek regular bail in connection with Kateya P.S. Case No. 108 of 2023 dated 11.03.2023 lodged under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302, 504 & 506 of the I.P.C.
4. As per the prosecution case, the F.I.R. has been lodged against 19 named accused persons including the petitioners.
5. Counsel for the petitioners submits that upon perusal of the F.I.R., it become very much clear that the dispute took place between the informant and petitioners' side with a view to take possession on the land and upon open fight
Patna High Court CR. MISC. No. 38944 of 2023(2) dt.07-07-2023 2/2 between them, injury took place.
6. Counsel further submits that the specific allegation in this case is against Rudal Ram, Munna Ram and Shrawan Ram and petitioners are different from them.
7. Counsel submits that petitioner No.1 is female aged about 54 years and petitioner No.2 is the male aged about 56 years. Counsel submits that petitioners are in custody since 11.03.2023 having clean antecedent.
8. Learned counsel for the State opposes the prayer for bail.
9. In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 108 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
10. With this observation, the bail application stands allowed.
