Petitioner seeks regular bail in connection with Gogri PS Case No. 277/2020 registered for the offence punishable under Sections 25(1-b) a/26 (ii)/35 of the Arms Act. One loaded country made pistol has allegedly been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to previous enmity and at the behest of seizure list witness, namely, Sanjit Yadav. He next submits that all the four cases which have been registered against the petitioner were lodged by Sanjit Yadav and his family members. It is further submitted
Patna High Court CR. MISC. No.47478 of 2021(3) dt.26-04-2022 2/2 that the petitioner is in custody since 28.07.2020 and the chargesheet has been submitted in the matter. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 28.07.2020, the charge-sheet has been submitted in the matter and the petitioner has not been made accused in similar nature of offence earlier, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, DHODHO YADAV be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of Smt. Pallawi Anand, learned Judicial Magistrate 1st Class, Khagaria/the court concerned in connection with Gogri PS Case No. 277/2020, GR No.2202/2020.
