This application for regular bail arises out of Rajgir P.S. Case No. 139 of 2020, disclosing the offence under Section 7 of the Essential Commodities Act.
Petitioners are ladies, who are in custody since 25.07.2020. On the basis of a secret information, the police allegedly recovered 1900 kg of rice being carried in three separate vehicles. Two of the persons, who were carrying the rice, were apprehended by the police who disclosed that they had purchased the rice from the petitioners and another person who were office bearers of Bharat Mata Jivika. Allegedly, the rice in question was meant to be distributed to the beneficiaries under Public Distribution System.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.35208 of 2020(2) dt.08-01-2021 2/2 petitioners has submitted that the so called disclosure made by the persons apprehended, is the only material against the petitioners and the stock of food-grains under petitioners' custody has not been verified nor any irregularity has been found so far.
Considering the aforesaid submission and the fact that the petitioners are in custody since 25.07.2020, this application is allowed.
Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), each with two sureties of the like amount, each to the satisfaction of learned S.D.J.M., Nalanda at Biharsharif, in Rajgir P.S. Case No. 139 of 2020.
