JUSTICE RAMESH KUMAR DATTA ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case under Sections 341,323,354 and 504 of the Indian Penal Code. Learned counsel for the petitioner submits that in the FIR the informant has totally omitted to state the fact that the petitioner is his own brother-in-law and own Mama of the girl. It is submitted that there was no question of the petitioner beating the girl rather it was a case where having found the activities of his sister's daughter vulgar he had objected to the same and due to certain family reason this has resulted in false implication of the petitioner. It is submitted that no injury report indicating any assault has been brought on the record.

No.35647 of 2014 (2) dt.20-02-2015 2/2 On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Sonu Kumar alias Subhash Kumar, in the event of his arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mithanpura P.S.Case No. 200/2014 to the satisfaction of the SDJM, East Muzaffarpur subject to other conditions laid down under Section 438(2) Cr.P.C.
