The petitioner apprehends his arrest in a case under Sections 147, 148, 149, 384, 341, 323, 324, 307, 354, 379, 504 of the Indian Penal Code.
It is submitted that the petitioner along with 13 others are named in the F.I.R. Badri Narayan Yadav is said to have assaulted the informant with Farsa on his head and Ram Bahadur Yadav and Niras Yadav assaulted the informant with iron rod and lathi. No specific allegation of assault is made against the petitioner. Badri Narayan Yadav has already been enlarged on anticipatory bail vide order dated 03.12.2015 passed in Cr. Misc. No. 54729/2015.
It appears that no specific allegation of assault is made against the petitioner and the case of the petitioner stands on
Patna High Court Cr.Misc. No.16401 of 2016 (2) dt.09-05-2016 2/2 better footing than that of Badri Narayan Yadav. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Jhanjharpur, Madhubani in Ghoghardiha P.S. Case No. 36 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
