The petitioner seeks regular bail in connection with Chanpatiya P.S. Case No.568 of 2023 registered for the offence under sections 366-A/34 of the Indian Penal Code and under sections 4 and 8 of the POCSO Act. 3.

The petitioner is accused of kidnapping the victim girl. He is in custody since 15.04.2025. 4.

Learned counsel for the petitioner submits that the petitioner and the victim girl were in relationship and the present F.I.R. has been lodged after a delay of seven days. 5.

Learned counsel for the informant has

Patna High Court CR. MISC. No.40973 of 2025(4) dt.15-10-2025 2/2 vehemently opposed the prayer of the petitioner for grant of bail.

From the statement of the victim girl recorded under section 164 of the Cr.P.C., it appears that the petitioner and the victim girl were in relationship and because of that the victim had eloped with the petitioner. 7.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge, VIcum- Special Judge, POCSO, Bettiah, West Champaran / concerned Court below, in connection with Chanpatiya P.S. Case No. 568 of 2023.
