The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392, 412/34 of the Indian Penal Code.
As per FIR, the allegation against three unknown miscreants is that they boarded on a motorcycle came and on pistol point snatched motorcycle of the informant and fled away.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Neither the petitioner is named in the FIR nor he was put on TIP and nothing looted
Patna High Court CR. MISC. No.38271 of 2023(2) dt.04-07-2023 2/2 article has been recovered from his conscious possession. It is further submitted that the petitioner was remanded in this case from another case on 11.05.2022 and languishing in judicial custody since 27.02.2021.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chanpatiya P.S. Case No. 34 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-Xth, West Champaran, Bettiah.
