Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-02-2021 Heard learned counsel for the petitioner and the State. Earlier the petitioner was granted anticipatory bail by this Court vide order dated 20.03.2020 passed in Cr. Misc. No. 1659 of 2020 with the following conditions:

"(a) The petitioner will hand over the possession of the flat to the informant, if not already handed over, at the earliest preferably within a period of six months from today.

(b) In addition thereto, the petitioner has to tender his service as a volunteer for a period of three months from the date of his release in the process of combating Corona virus. The petitioner is required to report the Civil Surgeon, Patna on his release so that his services may be utilized by the Civil Surgeon,

Learned counsel for the petitioner submits that the petitioner after release gave his joining before the Government Hospital, Civil Court, Patna on 30.05.2020 and worked there and thereafter the petitioner himself became Corona positive on 21.07.2020 and after becoming negative he further joined in the office of Medical Officer Primary Health Centre, Civil Court, Patna on 17.08.2020 and worked there till 30.08.2020. In the aforesaid circumstance, the petitioner has filed the present modification application for extension of further time for fulfilling the condition no.(a).

Considering the reason assigned in this modification application, the same is allowed. The petitioner is granted three months (three months) further time from the date of communication of this order to fulfill condition no.(a). The other part of order dated 20.03.2020 shall remain intact.
