The petitioner is apprehending his arrest in a case registered for the offences punishable u/s 147, 149, 151, 152, 186, 188, 323, 333, 337, 338, 379, 427, 436, 353, 307, 504 of the Indian Penal Code and u/s 27 of the Arms Act. As per allegation in the F.I.R., when the police officials came to arrest the accused persons who were involved in Sigori P.S. Case No. 50 of 2021, the accused persons along with the petitioners created hindrance in discharging the duty of police officials It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. There is no specific
Patna High Court CR. MISC. No.38444 of 2022(2) dt.01-12-2022 2/2 allegation against the petitioner and he is not involved in antisocial activities. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. It is also submitted that similarly situated co-accused persons have been granted bail by this court via order dated 31.08.2022 and 12.10.2022 passed in Cr. Misc. No. 32873 of 2022 and 25251 of 2022 respectively.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, III, Danapur, Patna in connection with Sigori P.S. Case No. 51 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
