Petitioner seeks bail in Baniapur P.S. Case No.139 of 2018 instituted for the offence under Section(s) 304-B/34 Indian Penal Code.
Counsel for the petitioner submits that husband of the deceased is not accused in this case. First Information Report has been lodged by mother of deceased alleging that husband of the deceased lives in Delhi. She got information that her daughter has been killed in her Sasural. She went to her daughter's Sasural and found the house locked. She has levelled allegation against the petitioner, who is brother-in-law (Dewar) of the deceased along with sister-in-law (Gotani) and mother-inlaw. She has not made her son-in-law as accused in instant case.
Patna High Court CR. MISC. No.39295 of 2019(3) dt.21-08-2019 2/2 Petitioner is in custody since 05.03.2019 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 11th, Chapra, Saran, in connection with Baniapur P.S.
