Petitioner seeks bail in Srinagar Pujaha P.S. Case no. 151 of 2018 registered under sections 363, 366A, 504, 506/34 of the Indian Penal Code and section 8 of the POCSO Act. Informant alleged that the petitioner and others enticed away his minor daughter.

Learned counsel for the petitioner submits that the victim made her statement under section 164 Cr.P.C in which she disclosed her age as 20 years and said that she voluntarily left her house and married with the petitioner at Thawe temple. Taking into consideration the facts that the victim herself denied the factum of her kidnapping and said that she voluntarily left her house and married with the petitioner and she wants to live with the petitioner, petitioner is directed to be
