JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 419, 420, 467, 406, 468, 471 of the Indian Penal Code. The petitioner was Secretary of Gram Katchheri, Pursauliya Gram Panchayat under the district of Madhubani. Learned counsel appearing on behalf of the petitioner, referring to the First Information Report, submits that the only allegation against him is of violation of rules framed for appointment of Niyay Mitra. He further submits that the petitioner was not named in the First Information Report and that there is no material, on the basis of which, it can be said that any criminal offence is made out. I find

In view of the above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Madhubani, in connection with Kaluahi P.S. Case No. 120 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
