No. 604 of 1993 was dismissed on 17.07.2018 for non-compliance of the order of the Lawazima Board for filing a petition of jointness of the respondent who had received notice of other respondents.

This application is for setting aside the dismissal by impugned order dated 17.07.2018 and restoration for the same on the ground that due to illness, the learned counsel for the appellant could not attend the Court.

After hearing the parties, the prayer is allowed, subject to the condition that the appellant shall deposit Rs. 1000/- in the Victim Compensation Fund.
