JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1899 of 2013 registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

On appearance of opposite party No.2 the matter was referred to the Patna High Court Mediation and Conciliation Centre and the report of Mediator at Flag 'M' disclosed that the parties have resolved their dispute through process of mediation on the terms mutually agreed between them, which is annexed with the report, from

Patna High Court CR. MISC. No.37094 of 2019(3) dt.20-09-2019 2/3 which it appears that first party will pay Rs.80,000/- by 11.9.2019 and second instalment of Rs.50,000/- by 11.11.2019 and last instalment of Rs.20,000/- by 12.12.2019. Both the parties have admitted the above fact and further learned counsel for the petitioner has submitted that he has already prepared a Bank Draft in favour of opposite party No.2 but the same was not accepted and he is still ready to handover the same before this Court or before the court below.

In view of above facts, as stated above, let petitioner appear in the court below on 30.9.2019 and on that opposite party No.2 shall also remain present in court, and petitioner shall hand over the Bank Draft of Rs.80,000/- to opposite party No.2 and on that the provisional bail granted to the petitioner by order dated 18.6.2019 shall be extended for a further period of four months, during that period petitioner petitioner has to deposit the second and third instalment and once the total amount is deposited and handed over to opposite party No.2 the provisional bail granted to the petitioner shall be confirmed. It is made clear that both the parties shall abide by the terms and conditions

Patna High Court CR. MISC. No.37094 of 2019(3) dt.20-09-2019 3/3 mutually agreed upon between them before the Mediator. Accordingly, this application is disposed of with the above direction.

Let copy of the report of Mediator along with the memorandum of agreement be sent to the court concerned forthwith for needful.
