ANJANA MISHRA ORAL ORDER 17-05-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners being the mother-in-law, father-in-law and brother-in-law (Dewar) are apprehending their arrest in connection with Dhamdaha P.S. Case No. 305 of 2015 for the offences registered under Sections 304(B)/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the death in question was a natural death and may have occurred on account of complication regarding pregnancy, as the victim lady was likely to deliver a baby child towards the end of the month of November, 2015. It is further submitted that the allegation

Considering the nature of allegation and the materials which have been produced before this court, it appears to be a case where the entire family has been roped in on mere suspicion, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 305 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Jagdish/- U T
